Use of an Interstate Wire Communications Device

To commit wire fraud a person must use some kind of interstate communications device. Interstate communications devices can be almost anything that send, receive, or otherwise transmit messages across state lines. Wire fraud charges can arise when someone uses a phone, a fax machine, e-mail, or any kind of Internet communication device to transmit messages.

If you get a copy of Id or Drivers License...when any person wants you to send money...they commit wire fraud.

Intent and the Scheme to Defraud

A person cannot accidentally commit wire fraud. In order to secure a conviction, federal prosecutors must show that a defendant acted with the intent to fraudulently deprive someone of money, property, or something of value.

I just saw your previous post and who you were talking about. None of what you said would hold up (I work in law enforcement and see stuff like this all the time). You saw a bunch of naked pictures of some skinny twink and you sent some money to that person to get him into your bed. You're an "employer" but you have no intentions of reporting the taxes, and sex is one of the things you're getting from paying this person.

Giving money to someone for the exchange (or attempted exchange) of a sexual favor is called (many different forms of) prostitution. You can threaten this guy with legal terms, but you know you can't file anything on him. You cannot sue him because he didn't show up and give you the sex you were gunning for.
